Terms of Service

1. The service

Factrapic ("the Service") is operated by Tychetech Ltd, a private limited company registered in the Republic of Cyprus, with registered office at 31 Evagorou, Nicosia 1066, Cyprus, VAT number CY10357073X ("we"). It lets you upload photos, recognises faces in them, and helps you organise, share and export the result. 2. Your account

You sign in with one-time email links. You are responsible for the security of your mailbox and for everything done under your account.

3. Your content and the people in it

You keep all rights to your photos. Before your first upload you confirm, and you re-confirm with every upload, that you own the rights to the photos or hold the photographer's permission, that you have a lawful basis under the GDPR to process the faces in them (including any consent required from the people photographed), and that you will only share them with people entitled to see them. You are the data controller; Factrapic processes the photos on your instructions.

4. Plans and payments

A Project purchase (one-off) keeps one project active for 12 months from creation with up to 5,000 photos; it becomes read-only afterwards until renewed. An Organization subscription (yearly, auto-renewing) covers every project you create while it is active, under fair use: up to 30 active projects and 30,000 uploaded photos in any 12-month period. We may ask you to upgrade or reduce usage above those limits. You can cancel from your account page; access continues until the end of the paid period. Prices are shown excluding VAT; VAT is added at checkout according to your country and, for EU businesses, your VAT number. Payments are processed by Stripe and are non-refundable except where the law requires otherwise. If you are a consumer in the EU you may withdraw within 14 days of purchase unless you have already started using the plan, which you agree to by creating a project or uploading. AI credit is a prepaid balance bought in top-ups; each AI identification run deducts the provider's actual cost plus 50% per photo processed. Credit does not expire but is not refundable or transferable. AI results are read from visible text (badges, name tags, table cards) and your attendee list, never from a person's appearance, and are suggestions you must review.

5. Acceptable use

Do not use the Service to identify people without a lawful basis, to harass anyone, or to upload content you have no right to.

6. Termination

You can delete a project at any time; its files are removed. We may suspend accounts that breach these terms.

7. Liability

The Service is provided "as is". Recognition results are suggestions and may be wrong; verify before relying on them. To the extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim.

8. Data protection

We process personal data in your projects as your processor under a data processing agreement that forms part of these terms: we act only on your instructions, keep the data in the European Union, use the sub-processors listed in the Privacy Policy, assist you with data-subject requests, notify you of personal-data breaches without undue delay, and delete or return the data when the project or account is deleted.

9. Governing law

These terms are governed by the laws of the Republic of Cyprus. Disputes are subject to the exclusive jurisdiction of the courts of the Republic of Cyprus, without prejudice to the mandatory consumer-protection rules of your country of residence if you are a consumer in the EU.
